Terms of Service

Effective Date: January 1, 2026

Welcome to Climb Digital Agency. By accessing our website or engaging our services, you agree to the following terms. Please read them carefully.

1. Services

Climb Digital Agency provides digital marketing, web design and development, branding, social media management, and related creative services. The specific scope of work for each client is outlined in a separate service agreement or proposal.

2. Payment

All services require a signed agreement and deposit before work begins. Payment schedules, rates, and deliverables are detailed in your individual contract. Late payments may result in paused work or additional fees as outlined in your agreement.

3. Intellectual Property

Upon receipt of full payment, clients retain ownership of all final deliverables created specifically for them. Climb Digital Agency retains the right to display completed work in our portfolio, case studies, and marketing materials unless otherwise agreed in writing.

4. Client Responsibilities

Clients are responsible for providing accurate information, timely feedback, and any necessary assets (logos, photos, copy, credentials) needed to complete the project. Delays caused by the client may affect project timelines and deadlines.

5. Revisions & Scope

Revisions are limited to the number specified in your service agreement. Work outside the agreed scope will be quoted and billed separately.

6. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the engagement and not to disclose it to third parties without prior written consent.

7. Limitation of Liability

Climb Digital Agency is not liable for indirect, incidental, or consequential damages arising from the use of our services. Our total liability shall not exceed the total fees paid by the client in the three months preceding any claim.

8. Termination

Either party may terminate services with written notice as outlined in the signed service agreement. Fees for work completed up to the termination date remain due and payable.

9. Governing Law

These terms are governed by the laws of the State of Maryland, without regard to conflict of law principles.

10. Changes to These Terms

We reserve the right to update these terms at any time. Continued use of our services following any changes constitutes acceptance of the revised terms.
